End User License Agreement
Last updated: November 6, 2026
This End User License Agreement (“Agreement”) is a legal agreement between you and HamsterDay LLC, a Wyoming limited liability company (“we”, “us”), for the game Boss'em Inc.™ and any related updates, content or documentation (the “Game”).
By installing, copying or playing the Game, you agree to this Agreement. If you do not agree, do not install or use the Game.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your private, non-commercial entertainment.
2. Restrictions
You may not:
- copy, distribute, rent, lease, lend, sell or sublicense the Game, except as expressly permitted by the platform you bought it on;
- reverse engineer, decompile or disassemble the Game, except to the extent that such restriction is prohibited by applicable law;
- modify, translate or create derivative works of the Game;
- remove or alter any copyright, trademark or other proprietary notice;
- use cheats, automation software, bots, hacks or any unauthorized third-party tool to alter the Game or gain an unfair advantage;
- use the Game for any commercial purpose, including esports events with paid entry, without our written permission.
3. Ownership
The Game is licensed, not sold. We and our licensors retain all right, title and interest in and to the Game, including all intellectual property rights. All rights not expressly granted are reserved.
4. Platform terms
The Game is distributed through third-party platforms. Your use of a platform is governed by that platform's own terms, including the itch.io Terms of Service, the Steam Subscriber Agreement and the Google Play Terms of Service. If this Agreement conflicts with a platform's mandatory terms, the platform's terms prevail to the extent of the conflict.
Purchases, refunds and payment processing are handled by the platform, not by us.
5. Updates
We may release updates, patches or new content, and may change or discontinue features. We are not obligated to provide support, updates or continued online functionality for any minimum period.
6. User content
The Game does not allow you to create or upload content that is visible to other players. No user-generated content license is granted or required.
7. Privacy
Our handling of personal information is described in the Privacy Policy at https://hamsterday.com/privacy/. The Game does not collect personal information.
8. Disclaimer of warranties
To the maximum extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Game will be error-free or uninterrupted.
Nothing in this Agreement excludes or limits any warranty or right that cannot be excluded or limited under the law of your country of residence.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising out of or related to the Game.
Our total aggregate liability under this Agreement is limited to the amount you paid for the Game in the twelve months before the claim.
Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.
10. Termination
This license terminates automatically if you breach this Agreement. On termination you must stop using the Game and delete all copies. Sections 2, 3, 8, 9 and 11 survive termination.
11. Governing law and disputes
This Agreement is governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules. The courts located in Wyoming have exclusive jurisdiction, except that mandatory consumer protection rules in your country of residence may give you the right to bring a claim locally.
Before filing a claim, contact us at contact@hamsterday.com so we can try to resolve the matter informally.
12. General
If any provision is held unenforceable, the remaining provisions stay in effect. This Agreement, together with the platform terms and our Privacy Policy, is the entire agreement between you and us regarding the Game. We may assign this Agreement; you may not. A failure to enforce a provision is not a waiver.
